This Privacy Policy complies with the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). California residents have specific rights regarding their personal information. See Section 9 for your full rights. We do not sell your personal information. We do not share it for cross-context behavioral advertising.

1. Who We Are

JuNXLMS is a cloud-based Learning Management System operated by JuNX LLC, a California limited liability company ("JuNX," "we," "us," or "our"). Our platform helps workforce development organizations, educational institutions, and employers manage training programs, track learner progress, and generate compliance documentation.

2. Information We Collect

2.1 Information You Provide

  • Account registration: name, email address, password, organization name, role
  • Profile information: job title, phone number, employer affiliation
  • Payment information: billing address, payment method (processed by third-party payment processor — we do not store full card numbers)
  • Communications: support requests, feedback, and correspondence with our team

2.2 Information We Collect Automatically

  • Usage data: pages visited, features used, time spent, actions taken within the platform
  • Device information: browser type, operating system, IP address, device identifiers
  • Log data: server logs, error reports, access timestamps
  • Cookies and similar technologies: session cookies, preference cookies, analytics identifiers

2.3 Information From Institutions (FERPA-Governed Data)

When institutions use JuNXLMS to manage student education records, we process that data as a "school official" under FERPA and as a "service provider" under CCPA. This data is governed by our FERPA Data Use Agreement with the institution. Learner data provided by institutions includes:

  • Student identifiers: name, student ID, email address
  • Enrollment and attendance records
  • Training outcomes, assessment scores, and certificate records
  • Employment information: employer name, work site, job title
  • ETP eligibility and financial records (if provided by institution)

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the JuNXLMS platform
  • Process enrollments, track training hours, and generate compliance reports
  • Send administrative communications (account alerts, system updates, invoices)
  • Respond to support requests and troubleshoot issues
  • Analyze usage patterns to improve platform features and performance
  • Comply with legal obligations, including ETP reporting requirements
  • Enforce our Terms of Service and protect the security of the platform

We do not use personal information for behavioral advertising, sell data to third parties, or use student education records for any purpose other than the Authorized Purpose defined in our FERPA Data Use Agreement.

4. How We Share Your Information

4.1 Service Providers

We share information with third-party vendors who help us operate JuNXLMS, including cloud infrastructure (AWS), payment processing, email delivery, and analytics. All service providers are bound by data processing agreements and may only use your data as directed by us.

4.2 Institutions

If you are a learner or employer accessing JuNXLMS through an institutional subscription, we share your activity data with the institution that manages your program. This is governed by our FERPA Data Use Agreement.

4.3 Legal Requirements

We may disclose information when required by law, court order, or government authority, or to protect the rights, safety, and property of JuNX LLC, our users, or the public.

4.4 Business Transfers

If JuNX LLC is acquired, merged, or its assets are transferred, your information may be transferred to the successor entity. We will notify you of any such change via email or prominent notice on our website.

5. Cookies & Tracking Technologies

JuNXLMS uses cookies and similar technologies to operate the platform, remember your preferences, and understand usage patterns.

You can control non-essential cookies through your browser settings. Disabling cookies may affect platform functionality. We do not use third-party advertising cookies or tracking pixels for behavioral advertising.

6. Data Retention

We retain your information for as long as your account is active or as needed to provide services. Specifically:

  • Account data: retained for the duration of your subscription plus 3 years after termination
  • Usage logs: retained for 12 months
  • Payment records: retained for 7 years as required by tax law
  • Student education records (FERPA): retained per the terms of the FERPA Data Use Agreement with your institution, and deleted or returned upon request within 30 days of contract termination
  • Backup copies: may persist for up to 90 days after deletion requests are processed

7. Security

We implement commercially reasonable technical, administrative, and physical safeguards to protect your information, including:

  • TLS 1.2+ encryption for all data in transit
  • AES-256 encryption for data at rest via AWS infrastructure
  • Role-based access controls limiting data access to authorized personnel
  • AWS Cognito identity management with multi-factor authentication support
  • Multi-tenant data isolation — each institution's data is segregated
  • Audit logging of all data access and modifications
  • 72-hour breach notification to affected institutions

8. Children's Privacy

JuNXLMS is designed for use by adult learners (18+) in workforce development programs. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided personal information, we will delete it promptly. If you believe a child has submitted information to JuNXLMS, contact us at info@junxlms.com.

9. California Privacy Rights (CCPA / CPRA)

California residents have the following rights under the CCPA and CPRA:

10. Data Transfers

JuNXLMS is hosted on AWS infrastructure in the United States. If you access JuNXLMS from outside the United States, your information may be transferred to and processed in the United States, where data protection laws may differ from those in your country. By using JuNXLMS, you consent to this transfer.

11. Third-Party Links

JuNXLMS may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any information.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated policy on junxlms.com with a new "Last Updated" date. For material changes, we will notify you by email or prominent notice within the platform at least 30 days before the change takes effect.
